Welcome to Amberpaws. By using our iPhone application and services, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of terms

By creating an account or using Amberpaws, you confirm you are at least 13 years old (16 in the EU) and that you agree to these Terms and our Privacy Policy.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials.
You must provide accurate and complete information.
You may not create multiple accounts, impersonate others, or misrepresent your identity.
You can delete your account and all associated personal data at any time from in-app Settings.
We may suspend or terminate accounts that violate these terms.

3. Acceptable use

You agree not to:

Use Amberpaws for illegal purposes or in violation of local laws.
Harass, threaten, or harm other users.
Share false, misleading, or harmful content.
Attempt to reverse engineer, scrape, or exploit our systems.
Abuse the AmberBrain AI assistant (excessive automated requests, spam).
Resell or redistribute any part of our services.

4. User content

You retain ownership of content you upload (photos, pet profiles, posts). By posting, you grant Amberpaws a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content solely to operate the service.

You are solely responsible for the content you share. We may remove content that violates these terms or applicable laws.

5. Premium (Verified) subscription

Premium is a paid auto-renewing subscription managed through your Apple ID.
Pricing and features are shown in-app at the time of purchase. Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
You can manage or cancel your subscription anytime in your iPhone's Settings → Apple ID → Subscriptions. Cancelling stops the next renewal but does not refund the current period.
Refunds are processed according to Apple's App Store refund policy.
Verification requires valid government-issued ID. Amberpaws reserves the right to reject verification requests at our discretion.

6. AmberBrain AI disclaimer

AmberBrain AI provides general information only and is not a substitute for professional veterinary advice. Always consult a licensed veterinarian for medical concerns about your pet. Amberpaws is not liable for decisions made based on AI responses.

7. SmartQR and Boss Events

SmartQR tags are tools to help reunite lost pets. We cannot guarantee a pet will be found.
Boss Events prizes are awarded only to users who physically attend live events and meet the stated conditions. Prizes are subject to availability and local regulations.

7a. Buying the Amberpaws Guard

Seller: Cristian Jimenez, sole trader under the brand “Amberpaws”, Rathausmarkt 19, 41747 Viersen, Germany (see Impressum), info@amberpaws.app.
Price: the price shown at checkout (EUR 19.99 per Guard) includes VAT. Shipping to every EU country is free. We do not ship outside the EU.
Contract: the order page is an invitation to buy. Your order becomes binding when you complete payment; the contract is concluded when we send the order confirmation by email.
Payment: processed securely by Stripe (card, Apple Pay, Google Pay and other methods shown at checkout). Amberpaws never sees or stores your full card details.
Delivery: we ship from Germany, usually within 1–2 working days. Delivery normally takes 3–7 working days. You receive an invoice by email.
Warranty: the statutory warranty rights (2 years) apply.
The Guard works with the free Amberpaws app. Lost-pet mode and the public pet profile are free; Premium is an optional subscription (section 5).

7b. Right of withdrawal (consumers)

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods.

To exercise the right of withdrawal, you must inform us (Cristian Jimenez – Amberpaws, Rathausmarkt 19, 41747 Viersen, Germany, info@amberpaws.app) of your decision by an unequivocal statement (e.g. an email). You may use the model withdrawal form below, but it is not obligatory. To meet the deadline, it is sufficient to send your communication before the withdrawal period has expired.

Effects of withdrawal: we will reimburse all payments received from you, including the costs of delivery, without undue delay and no later than 14 days from the day we are informed of your decision, using the same means of payment you used. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier. Please send the goods back within 14 days. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

8. Intellectual property

The Amberpaws name, logo, app design, and mascots are trademarks of Amberpaws. You may not use them without written permission.

9. Third-party services

Amberpaws integrates with services from Apple (Sign in with Apple, AirTag, Find My, Apple Maps, MapKit) and a small number of essential providers (payment processing, error monitoring). Your use of these services is subject to their respective terms.

10. Termination

You may delete your account at any time from in-app Settings. Account deletion permanently removes your personal data within 30 days, except where retention is required by law. We may suspend or terminate accounts that violate these terms. Memorial Mode profiles can be preserved at the owner's explicit request, as described in our Privacy Policy.

11. Liability

Amberpaws is provided “as is”. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the past 12 months.

12. Governing law

These Terms are governed by the laws of the jurisdiction where Amberpaws is registered. Disputes will be resolved in the courts of that jurisdiction, unless mandatory consumer protection laws in your country provide otherwise.

13. Changes to these terms

We may update these Terms from time to time. We'll notify you of material changes at least 30 days in advance. Continued use of Amberpaws after changes means you accept them.
